We encourage you to review the Terms of Use whenever you use any Medica Site. The following Terms of Use govern your access and/or use of the Medica.com Web site and any other Web site that is owned by Medica Health Plans (“Medica”) that you directly access and/or use or access/use through Medica.com. The other Medica owned sites include, but are not limited to, MainStreetMedica.com, mymedica.com, medicasolo.com, medicafoundation.org, medicaresearchinstitute.org, medicalistens.com and MedicaHealthManager.com and are referred to as the Medica Site or Medica Sites.

By accessing or using any of the Medica Sites you agree that you will comply with, and that your access/use will be governed by, the following Terms of Use.

The Terms of Use govern your access/use of both the publicly available portion of the Medica Sites and the private portion which is available only to users who provide an account name and password. In addition, the Medica Sites may contain links to third party Web sites which provide information and/or services that might be useful to you. When you follow links to any third party website, you agree that your use of such Web site will be subject to the terms and conditions posted on that Web site.

By your access/use of any Medica Site, you agree that you will access/use the Medica Site only for personal lawful purposes. You agree that any copying, distribution, indexing, mining, publication, reproduction, resale or transmission of any content contained on any Medica Site or on any other site that you access/use through any Medica Site is strictly prohibited.

You are permitted to access and make personal use of the Medica Sites. This use, however, does not include the use of data mining or similar data gathering and extraction tools. The content or any part of the content of any Medica Site may not be reproduced, duplicated or copied (other than for the purposes of page caching) or sold, resold, or otherwise exploited for any commercial purpose or non-personal purpose without the express written consent of Medica, or its respective third party content providers. All other rights are reserved.

Any medical or healthcare information provided and hosted on any Medica Site is designed to support, not replace, the relationship that exists between you as a patient/site visitor and your physician. Any access/use by you of any Medica Site or use by you of the information contained on any Medica Site or third party site accessed through a Medica Site is at your own risk. Medica and the third party suppliers of any information contained on any Medica site will not be responsible for the consequences of your decision to utilize the information contained on the Medica Site.

Where appropriate, information contained on Medica Site(s) will be supported by reference to source data and, where possible, have specific links to that data.

Although Medica has used reasonable precautions to safeguard the confidentiality of information received and sent over the Internet or electronic mail (e-mail), Medica cannot guarantee the confidentiality of such information. If you correspond with us via the Internet or electronic mail (e-mail) you agree to waive claims against Medica and its suppliers regarding any third party’s access to or use of information that you provide to Medica or information that you receive from Medica. The information you provide to establish your user profile will be retained by Medica and will be used by Medica for profile maintenance only.

All content on any Medica Site including, but not limited to, text, graphics, logos, icons, images, data compilations, content compilations and software, is the property of Medica, or its third party content providers and is protected by United States and international copyright laws.

You understand and expressly agree that use of the MEDICA SITES, AND THE MATERIALS ON THE SITES, ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. MEDICA DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS.

MEDICA DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, VALIDITY OR ACCURACY OF, OR THE RESULTS OF THE USE OF, ANY SERVICES OR INFORMATION REVIEWED OR PROPERLY OBTAINED ON OR THROUGH THE MEDICA SITES, REGARDING ANY TRANSACTION(S) ENTERED INTO THROUGH THE MEDICA SITES OR THAT MEDICA’S SITES WILL MEET ANY USER’S REQUIREMENTS, BE UNITERRUPTED, TIMELY, SECURE OR ERROR FREE, RESPECTING THE MATERIALS ON MEDICA SITE(S) OR ANY THIRD PARTY SITES ACCESSED FROM A MEDICA SITE. UNDER NO CIRCUMSTANCES INCLUDING, BUT NOT LIMITED TO, MEDICA’S NEGLIGENCE SHALL MEDICA BE LIABLE FOR ANY DIRECT, INDIRRECT OR INCIDENTAL SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OR THE INABILITY TO USE A MEDICA SITE(S). IF YOU ARE DISSATISFIED WITH THE MEDICA SITE(S), THE INFORMATION ON OR THROUGH THE MEDICA SITE(S), OR WITH ANY OF MEDICA’S TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE MEDICA SITE(S)

Medica reserves the right to change the Terms of Use at any time without prior notice. Your use of any Medica Site following any such change constitutes your agreement to follow and be bound by the modified Terms of Use.

“Medica” refers to the family of health services companies that includes Medica Health Plans, Medica Community Health Plan, Medica Insurance Company, Medica Self-Insured, MMSI, Inc. d/b/a Medica Health Plan Solutions, Medica Health Management, LLC and the Medica Foundation.
